Work Accidents

Employers have an obligation under CA law to eliminate or reduce as much as  possible the risk of accidents at work.  But accidents happen. A lot of people get seriously injured at work due to the negligence of the employer or by the negligence of third parties.           

When a work accident happens, the employee is entitled to worker’s compensation for the injury and the loss of earnings caused to the employee or to his family regardless of who was at fault. Worker’s  compensation includes disability payments and medical care at no cost to the employee.

 In  addition to employees’ rights  under workers compensation law, in some circumstances an injured employee may have a right to bring a civil lawsuit against  other third parties for  their failure to act as  reasonable prudent persons causing unnecessary risks of accidents.  Premises Liability / Dangerous Condition  accidents

Let me put it this way, all property owners have the responsibility of making sure that their property is safe.  And if they know that their property is in a dangerous condition and they fail to do something about it, they will be responsible for the injuries caused to others. In legal terms “they are liable”.

For example, I remember the case of Mr. Hernandez, an immigrant hard worker in the county of Ventura, who injured his knee requiring surgery, taking him out of his job for months. And all because the  store owner failed to keep the floor of his store safe.  There was water and milk all over the store, dangerously exposing the customers to slip, fall and get injured.  

Currently, we are working on a case where a little boy - 8 years old- died on a crosswalk walking to school. Dangerous conditions of the school routes is under investigation.
